I quickly went through the document and it looks fine to me given the fact that we do not
actually know what kind of dual-use development we might have. With the proviso that I am
not an expert on Council Regulation (EC) No 428/2009 I have the following impression.
- the things described in chapter 3 come a bit out of the blue. How do we know there is a
dual-use item? who has decided to ask for permission? Who is the body deciding about that?
Would there be the possibility of redress? Would strategies to circumvent the unauthorized
topic be acceptable? I agree that the distribution of responsabilities is important.
- in my view, it would be better to first describe how SPARTA comes to realize there is a
dual-use item or development? that is to some extent already described in Chapter 4 (and
in the CA): the ethics committee is monitoring what's going on in SPARTA and reacts to
notifications from partners. The EC guidelines are helpful in this regard.
- then follows section 2.2 actions within SPARTA. That section is very succinct, but
perhaps sufficient since we have the rules in the CA. Yes.
- before notifying, some national authorities (Chapter 3) wouldn't we try to solve
the problem internally? Could a system be designed differently to avoid dual use? That
should be priority 1. I agree.
- in case that dual-use is unavoidable (or even intended) which national authority should
be contacted? In which country? Do we know what authority this would be (for Germany I
have to admit: I do not know...). Should we try to set up the list for this?
- and as I said in the beginning apart from the 4 solutions sketched it could be that a
development could also be terminated.

Dear Ethics Committee,
We made a first draft of D14.1 corresponding to the ethics requirements related to
dual-use. It is put in this directory:

Could you please have a look at it and give your opinion about whether this satisfies the
requirements on your opinion (see SPARTA Ethics Summary Report attached)? Any comment,
feedback, edits, experience you can share is welcome.
We also plan to contact leaders of the Roadmap, Partnership and Training & Awareness
activities along with the 4 programs to ask them whether they identified dual-use items in
there are. Do you see any other relevant activity in SPARTA which should be monitored
about this issue? We might wait a couple of days before contacting the leaders to wait for
your initial feedback first.
